TERROR PLOT SPECIAL SECTIONDENVER - A federal grand jury in Denver has indicted Mohammed "Wali" Zazi, 53, for making a false statement in a matter involving international and domestic terrorism.
U.S. Attorney David Gaouette and Denver FBI Special Agent in Charge James Davis announced the indictment Thursday afternoon. Zazi is presently free on a $50,000 bond.
His son, 24-year-old Najibullah Zazi, was arrested in Colorado after he was accused of plotting to make a chemical explosive device to apparently use in a terrorist plot in New York.
His father is set to appear in court on Friday.
The two were first arrested on Sept. 19 at their apartment in Arapahoe County.
They were both initially charged with making false statements to federal investigators in a matter involving terrorism. That charge was eventually dropped against Najibullah Zazi so he could be taken to New York to face the more serious terrorism charge.
Mohammed Zazi was indicted because the U.S. Attorney's office says he allegedly denied he talked to anyone by telephone over whether Najibullah Zazi was in any trouble, when he did talk in fact, on or about September 11, 2009, he did speak by phone with someone regarding whether Najibullah Zazi was in any trouble.
If convicted, Mohammed Zazi could get up to eight years in federal prison, a $250,000 fine, or both.
Najibullah Zazi is still in custody in New York.
