DELTA (AP) - There's another twist in a wrongful death lawsuit filed against a Western Slope doctor.

Sam Jahani's lawyer contends Jahani wasn't properly served with the lawsuit that John Moore of Cedaredge filed after his mother died in December and that Moore had no standing to sue.

A court in Delta had said last month that Jahani lost the case by default because he didn't answer a summons in time, but on Wednesday, Moore asked that the case be dismissed. He told the Montrose Daily Press that he was too stressed out by the fight to continue.

Jahani is one of two Western Slope doctors whose records were seized by federal agents last month. Authorities haven't released details of that investigation.
