Marvin Rosario-Lopez, 24, appeared in front of judge Monday morning. He is facing first degree murder charges for the death of Ronald Smith, 47, who was shot outside a nightclub near 11th Avenue and Broadway, where Smith's son was performing Sunday morning.

Ronald Smith's son, Andrew Smith, spoke about the incident shortly after Lopez's hearing.

"They say my brother had been assaulted. [I] went outside to see my brother. My dad got involved and just chaos from there," Ronald Smith said. "I wasn't there when the gunshots happened. I was across the street. I had been pepper sprayed so I was trying to wash out my own eyes."

Smith talked about the character of his dad and how he will be remembered.

"He was a great man, a family man," Ronald Smith said. "Even if you [were not] blood family, he treated you like family. At least he got to see my dream before he went home."

Smith talked about his brother who was injured in the incident.

"He's doing good. He's at home. He's resting. He's just trying to cope with all of this. I'm just trying to be the backbone for the family right now," Smith said.

Smith also talked about what it was like to be in the same room as the person who killed his father.

"Today was the first time I have ever seen him. It was hard seeing someone that took your daddy's life and affected your brother's life as well. But we're a strong family," Smith said.
