Police cleared in wounding of Fort Carson soldier

The El Paso County DA's office said Thursday that police Sgt. Tim Johnson won't be charged with any crime in the Aug. 12 shooting of Army Sgt. Stephen David Payne in Fountain. 

Payne faces charges including assault and false imprisonment. Fort Carson says Payne is a mechanic assigned to a military police unit and returned to active duty after he was released on a $25,000 bond.

The DA's office says police shot Payne when he allegedly drew a 9 mm handgun on them after he followed his wife and sons out of the house. Payne's lawyer didn't immediately return a message.
