COLORADO SPRINGS, Colo. (AP) - A trial is underway in a civil suit against a Colorado Springs liquor store owner who shot and wounded a man accused of stealing a bottle of vodka.

The Colorado Springs Gazette reports Bryson Dewberrry's lawyer said in opening statements Tuesday that Dewberry didn't deserve to be shot after the October 2010 incident.

Dewberry is seeking an unspecified amount for medical expenses, loss of work, pain, suffering and other factors.

An attorney for liquor store owner Chang Ho Yi says he had been struck in the head and was acting in self-defense.

A grand jury declined to indict the store owner after the shooting.

The lawsuit says Yi pursued Dewberry out of his store and shot him at close range after he got into a car.
