The Denver Post reports that attorneys for Holley Realty & Management filed the eviction papers Wednesday in Adams County Court.
Holmes is charged with killing 12 people and wounded 58 at an Aurora movie theater on July 20.
He has been jailed since the day of the shootings, and police dismantled the booby traps in his Aurora apartment and removed evidence.
Victor Sulzer, a lawyer for the landlord, says the eviction papers were filed because Holmes' lawyers haven't agreed to voluntarily surrender the apartment.
A spokesman for Holmes' attorneys didn't immediately return a call.
